1. Parties and Definitions

These Terms of Service constitute an agreement between DMC Bilgi Teknolojileri ("DMC", "Company", "Service Provider") and the customer ("Customer", "User", "You") using the SentinelDB360 product. The "Service" covers the SentinelDB360 software and the related website/documentation.

2. Acceptance

By using the Service, you declare that you have read, understood, and accepted these terms. If you are using the Service on behalf of an organization, you acknowledge that you have the authority to represent and bind that organization.

3. License and Usage Rights

  • DMC offers SentinelDB360 in subscription or on-premise license models.
  • The license is non-transferable, non-sublicensable, limited, and revocable.
  • Reverse engineering, decompiling, or reselling the software is prohibited.

4. Customer Obligations

  • Account security and confidentiality of access credentials are the Customer's responsibility.
  • You agree not to use the Service in violation of applicable law, in a manner that infringes third-party rights, or in a way that constitutes misuse.
  • You own the data in the databases you connect for monitoring; DMC accesses this data only for the purposes set out in the agreement.

5. Fees and Payment

Subscription fees are listed on the pricing page for the relevant plan. Prices exclude VAT. Payments are taken monthly or annually in advance. Late payments are subject to the advance interest rate of the Central Bank of the Republic of Türkiye.

6. Service Level (SLA)

A 99.9% uptime target is committed for cloud-based subscriptions. For detailed SLA terms and service credits, see the SLA page. For on-premise deployments, the SLA depends on the customer's infrastructure.

7. Data Protection

Personal data processing is conducted in accordance with the Privacy Policy and the KVKK Information Notice. In cases where the Customer engages DMC as a data processor, the Data Processing Agreement (DPA) applies.

8. Intellectual Property

All rights to the SentinelDB360 software, source code, documentation, brand, and logos belong to DMC Bilgi Teknolojileri. The Customer is granted only the right to use under these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DMC's total liability is limited to the fees paid by the Customer in the 12 months preceding the date the claim arose. DMC is not liable for indirect, incidental, special, punitive, or consequential damages.

10. Termination

  • The Customer may cancel the subscription; the service continues until the end of the paid period.
  • DMC may terminate the Service in cases such as breach of terms, non-payment, or misuse.
  • On-premise license termination follows the conditions in the relevant agreement (typically termination of update rights and 30-day data export period).

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. Competent court: Istanbul (Çağlayan) Courts. Mediation may be tried before recourse to court (Mediation Law).

12. Changes

Material changes are announced at least 30 days in advance via email and on this page. Continued use of the Service constitutes acceptance of the updated terms.
